Grandfathered Health Plans | Rights and Protections

Are you one of those under grandfathered health plans?

If so, then some rights and protections offered under the Affordable Care Act may not apply to you. If you are unsure if you have a grandfathered health insurance plan then you should check your plan’s material or communicate with your health plan’s benefits administrator. Moreover, you must typically be notified by your insurer if you have a grandfathered plan.

Rights and Protections that grandfathered health plans may NOT have:

• free preventive care
• right to appeal a coverage decision
• choice of doctors and access to emergency care
• protection on excessive premium increases
• end yearly limits on coverage
• pre-existing health condition

Remember that it is still best to check with your insurance company to know more about your rights and protections under your plan.

More about grandfathered health plans:

There two types of grandfathered health plans. One is Job-based and the other is Individual which you may have bought directly from an insurance company or broker or agent.

Job-based grandfathered plans can still maintain their grandfathered status if the plans haven’t been changed to substantially cut benefits or increase costs for plan holders and have continuously covered at least one person since March 23, 2010.

Moreover, insurance companies can continue to offer the Individual grandfathered plans to people who were enrolled before March 23, 2010. And there must be a notice given 90 days before the plan ends if the insurer decides to stop offering a grandfathered plan.

If you would like to switch from a grandfathered plan into a Health Insurance Marketplace plan, you can do so within the Open Enrollment Period (Nov 1 – Dec 15). However, if your grandfathered plan year ends or is cancelled by your insurer, then you can enroll within 60 days before until 60 days after your plan ends.
